CHAPTER 7 BANKRUPTCY ATTORNEYS
Overwhelming debt? Being harassed by creditors? Have your wages been garnished, or have you been sued over debt?
Schedule a free consultation today with Peace Law to see how bankruptcy can provide relief and get you back on the right financial track. Chapter 7 is available to individuals and small businesses. Peace Law can help stop the collection calls, and help discharge many unsecured debts, including:
- Credit cards bills
- Medical bills
- Payday loans
- Wage garnishments
- Certain tax debts
- Personal loans
- Finance company loans
- Repossession deficiencies
Chapter 7 bankruptcy can have some very powerful effects to break the cycle of debt. Once filed, creditors are forbidden from attempting to collect the debt or even calling you, and most garnishments and lawsuits are immediately stopped. Small business can also file chapter 7 bankruptcy if they no longer wish to operate and have liabilities that need to be addressed.
Chapter 7 bankruptcy also provides dollar value exempts to consumer debtors for certain types of property, including your home, vehicles, and personal property, allowing you to keep these items if the value is within the exemption amounts. These exemptions apply to the equity you have in the property, not the total property value. For example, if you own a home worth $120,000 with a $100,000 mortgage, you can exempt the $20,000 in equity and keep your home and mortgage. Here are just a few examples of the types of property for which the Bankruptcy Code provides exemptions:
- Vehicles
- Homes
- Mobile homes
- Land
- Burial plots
- Household goods
- Clothing
- Firearms
- Jewelry
- Tools of trade
- Retirement accounts
- Animals and crops

CHAPTER 13 BANKRUPTCY LAWYERS
For those that do not qualify for Chapter 7 bankruptcy, or have a financial situation in which reorganization is more beneficial, Peace Law offers assistance with Chapter 13 bankruptcy. Chapter 13 provides a means by which more valuable, non-exempt property can be kept, with debts being reorganized based on monthly income. Chapter 13 may be the best solution for you in the following circumstances:
- Behind on mortgage payments
- Behind on car payments
- Need to reduce monthly car or mobile home payments
- In foreclosure proceedings
- Have valuable, nonexempt property you wish to keep
- Owe more than property is worth
- You have cosigners you wish to protect
- Received a Chapter 7 discharge within the last 8 years
In most cases, Chapter 13 greatly reduces your monthly payments to both secured and unsecured creditors, and any remaining balances owed to unsecured creditors upon the conclusion of the Chapter 13 are discharged completely. In Chapter 13 bankruptcy, you can “cramdown” some secured loans, meaning you can repay only what the collateral is worth, no what you owe for it. This literally saves some of our clients tens of thousands of dollars on upside-down car and mobile home loans.
Contact Peace Law to schedule a free consultation to confidentially discuss if Chapter 13 is the right solution for you.
DEBT RELIEF ATTORNEYS
In certain situations, bankruptcy may not be the best solution to deal with your debt. Peace Law can help determine if other forms of debt relief will provide a greater benefit. These include negotiation with creditors, and potential settlement or change of terms of existing debt. Peace Law can further assist with obtaining validation of the debt through the creditor or collections agency, and provide all defenses available under state and federal law.
In addition, Peace Law can help when debt collectors engage in collection practices that are in violation of the law, such as:
- Harassment
- Attempting to collect on false debt
- False or misleading representations
The Fair Debt Collection Practices Act provides rules debt collectors must follow, and violations of these rules can result in monetary damages of up to $1,000 and attorneys’ fees.
Call Peace Law at (606) 521-5500 in Corbin or (606) 802-5500 in Somerset or reach out through our contact form to confidentially discuss bankruptcy or debt relief. The initial consultation is always free.
