As a family law practitioner, it’s never easy to see someone contemplating dissolution (divorce). However, some couples mutually agree that the marriage has come to an end and want to take the steps necessary to end it amicably and efficiently. We call a divorce where the spouses have come to an agreement an “uncontested dissolution.“ The process for an uncontested dissolution is relatively simple and painless for the parties involved, not to mention far more cost effective than a contested divorce. The major steps in this process are discussed in this blog.
The first step in any dissolution proceeding is the initial consultation. During this initial consultation, your attorney will ask pertinent questions to understand your circumstances and determine if your case is uncontested. Many of the questions will be in regards to what is necessary information concerning the Petition for Dissolution of Marriage. This is the document that is filed initially with the court to start the process.
After the initial consultation, your attorney will draft all of the necessary documents to finish your dissolution, as well as waiving your appearance in Court to keep you and your spouse out of the Courts. Once drafted, we will give you a call and arrange a way for both parties to sign the documentation and then file these documents with the Courts. At the time of filing there is one particular caveat to address: If you have children in KY there is a 60-day statutory waiting period before the Judge can sign your decree of dissolution. The decree of dissolution is the document which legally dissolves your marriage. If there are no children involved, the presiding judge can sign off on the dissolution in a matter of days or weeks after it is submitted.
